| Summary: | This volume deals with the concept of so-called spillover effects in current legal discourse. But what do jurists mean when they talk of spillover effects? To find out, Martin Bialluchs main focus is on fundamental theoretical legal research in the field of methodology. Based on extensive observations in the fields of company transformation law and capital market law, he explains why, for the purposes of methodology, the term must be understood as a mere linguistic illustration of the results of certain forms of legal argumentation and as a collective term for certain legal states claimed in the legal sciences. Following the scientific imperative of parsimony, the work refuses to acknowledge spillover effects as a new type of doctrine in legal methodology. In einer Zeit, da Recht immer komplexer wird, hat wissenschaftliche Theorienbildung dem Gebot der Sparsamkeit zu folgen. Aus diesem Grund verdient stets die einfachste Theorie den Vorzug. Martin Bialluch untersucht dies eingehend anhand des Konzepts der Ausstrahlungswirkungen und kommt zu dem Schluss, dass die Ausstrahlungswirkung nicht als neuartige Figur der juristischen Methodenlehre anzuerkennen ist.
