This question was given a new urgency in the context of the debate on natural law. The volume offers a detailed analysis of the major landmarks and positions in the development toward a secularized substantiation of legal norms. In so doing it focuses not only on the theoretical resources and problems involved in such a substantiation but also inquires into the consequences and functions such normative processes have for political theory. Main description: In der Philosophie des 17. und des beginnenden 18. Jahrhunderts wurde politische Legitimität nicht zuletzt als Frage nach der gültigen und allgemeinverbindlichen Normenbegründung verhandelt, die vor allem in der Auseinandersetzung um das Naturrecht an Brisanz gewonnen hatte. Die sich dabei vollziehende Entwicklung zu einer säkularisierten Rechtsbegründung wird in ihren markanten Phasen und Positionen detailgenau analysiert. Das Interesse der Untersuchung gilt hierbei aber nicht nur den theoretischen Mitteln und Problemen der Normbegründung, sondern sie fragt auch nach den Folgen und Funktionen, die die normativen Festlegungen für die jeweilige politische Theorie haben. |
